Welcome to the Night Zoo. We believe that inside a zoo; animals should be well cared for and feel safe. Therefore if You are going to be an excellent night zookeeper You need to follow these simple rules stated here in Our Terms and Conditions. If there is anything on this page that You don’t understand then You should ask for Your parent or guardian’s help.

Our promise

We aim to bring all of the inventive potential of a piece of paper, online. We believe that great children’s games have imagination at heart and We understand that self-expression is as essential to learning as teamwork and play.

Nightzookeeper.com Explained

The Night Zookeeper Project is a unique education project which allows children to upload and share their completed stories or artwork online through a range of different activities. The project can be enjoyed both at school and at home either by Our users, be it alone or with their friends and family.

The central story of the Night Zookeeper Project ties the activities together and is fundamental to developing the creativity of every child that undertakes the project.

The Night Zookeeper Project encourages children to think creatively and enter the world of their imagination where anything is possible. Children are given the opportunity to invent their own characters that live in the Night Zoo and to write stories to bring their character to life. The Night Zookeeper Project also allows children to enhance their computer technology skills in learning how to upload files and interact with a safe online community.

To be able to use this Website and all of the features mentioned above You must agree to these Terms and Conditions before You register with us. If You do not agree with these Terms and Conditions You should not use this Website.

Definitions

The following words shall have the definitions set out below:

“Account” – means a registration for the Website which is free and which allows restricted access to, and use of the Website.

“Class” – means the name given to Your school class by Your teacher when they register Your Class for the Website;

“Class Code” – means the code which may be provided to You by Your teacher when they register Your Class for the Website;

“Materials” – means all artwork (including all paintings, drawings, sketches, photos, collages, prints and designs), stories or other creative writing pieces and all other activities uploaded by You to the Website;

“a Night Zookeeper” – means a user of the Website who has registered an Account and/or a Subscription;

“Night Zookeeper Project” – means all Night Zookeeper activities including all school led projects, the use of the Website and the use of all Products in the furtherance of Our Promise;

“Payments” – means any payment required to be made to Us in respect of any product or service provided or sold by Us and made in accordance with these Terms and Conditions and for the avoidance of doubt such payments shall include the Subscription Fee;

“Personal Information” – means all private and personal information other you’re your Public Information that may be provided to Us when you register for an Account and/or Subscription”;

“Private Information” – means Your username or class information (that you provide to Us when you register for the Website) and Your Materials;

“Products” – means any products licensed, produced, made, remade, sold or resold by Us or any third party company authorized to do so or any related company of Us that may be made available for public or private use whether or not such materials are issued free of charge or made available for sale;

“Subscription” – means a registration for the Website which incurs a Subscription Fee but which allows full access to, and use of the Website;

“Subscription Fee” – means a monthly payment made in respect of a Subscription being the sum of four pounds and ninety nine pence (£4.99) or such other price \(or equivalent value in any foreign currency as We may determine as being payable from time to time;

“Termination Date” – means the date:

on which You cancel Your Account and/or Subscription;
7 days after We are notified that You have instructed Your nominated bank to cancel the direct debit instruction which pays Your Subscription Fee; or
on which We terminate Your Account or Subscription in accordance with these Terms and Conditions;

“Terms and Conditions” – means this webpage which states all of the rules and regulations You must accept to use the Website.

“Us, We and Our” – means Wonky Star Ltd (16 Firbank, Euxton, Chorley, Lancashire, PR7 6HP) the owner of the Website.

“Website" – means www.nightzookeeper.com and any and all related pages, sites or online programs;

“You” – means the account holder or visitor to the Website.

Terms of Use

Rules

As a Night Zookeeper You will be expected to follow the rules of the Website. If we feel that You have violated these Terms and Conditions We reserve the right to terminate Your Night Zookeeper Account or Subscription. We will be monitoring Materials and reserve the right to refuse access to any Materials which We feel are inappropriate. We do not monitor any websites which may make reference to Us on their pages.

Respect

We believe that being respectful to fellow Night Zookeepers is of the highest importance. When using this Website You should not submit Materials that are or might be offensive or cause distress to another Night Zookeeper. You should not submit any Material that is considered to be illegal or may hurt somebody (this can sometimes be called unlawful, libelous and obscene). You also cannot include or submit any Material that uses a trademark of a third party or infringes copyright law. If You break these rules we reserve the right to remove Your Materials from the Website and terminate Your Account and/or Subscription.

Giving out information

When using the Website You must not reveal any Personal Information about Yourself. When registering for an Account and/or Subscription please select an original username which does not refer or include Your real name. When submitting Materials You must not include anything that has Your real name or any personal details of any kind. You should not pretend to be somebody You are not, whether this is a person You know, don’t know or someone You may have invented.

Legal

Own Use

Be honest when using the Website. Please only access the Website using Your Account and/or Subscription log-in information. Do not misuse the Website by interfering with someone else’s use of the Website. You must not use username’s or passwords which belong to other people. You should not try to avoid, circumvent or bypass any of the security measures of the Website.

Browsing the internet safely

We may provide links to other websites from time to time. However, we do not sponsor or endorse these websites and You should check their terms and conditions fully before using their websites. Please ensure that You also refrain from using any Personal Information on various other websites that You may visit.

Ownership

This Website and all the content on it are the property of Us. When You submit any Material to the Website it immediately becomes the intellectual property of Us for any use whatsoever.

We promise that all Materials will be used responsibly on the Website or on any Products (as far as We are able to control such use).

We will not disclose Your Private Information when using the Materials on the Website or on any Products but We reserve the right to use Your Public Information for such use.

If You decide to cancel Your Account on the Website and/or Your Subscription then You will be asked to confirm whether You wish for the Materials to no longer be used on the Website. If You choose for the Materials to no longer be used on the Website We will delete them from the Website as soon as reasonably practicable however We reserve all rights of ownership in respect of any previous or continuing use of the Materials on any Products.

Privacy Policy

Any Private Information will be used in accordance with our Privacy Policy. In accepting these Terms and Conditions You are also stating that You have read Our Privacy Policy and agree with its content.

Liability

We are committed to the Website being used solely for educational and entertainment purposes. We do not accept liability for the Website working perfectly and accept that there may be times when the Website is unavailable. To the maximum extent permitted by law, We exclude liability for any loss or damage of any kind arising out of Your use of the Website or any information, Materials or other items You obtained from Us, including without limitation any direct, indirect, punitive or consequential damages whether or not such arises out of any problem You may notify to Us and We shall have no liability to pay any money by way of compensation.

Terms of Service

Payments

All Payments made to Us are processed by Us in conjunction with PayPal.

Payments can only be processed using the credit or debit cards acceptable to PayPal from time to time.

Cardholders under the age of 19 are not permitted to make any Payment to Us and we reserve the right to request confirmation of the age of any person attempting to process any Payment to Us.

Subscription Fees

When You register for a Subscription You will be required to set up a Direct Debit for payment of the Subscription Fee.

The Subscription Fee shall be deducted from Your nominated bank account on the date of subscription and on the same day each calendar month thereafter (each such date being a “Payment Date”).

If Your Account and/or Subscription is terminated, You will not be entitled to a refund of any part of the Subscription Fee in respect of any period that falls after the Termination Date but before the next Payment Date.

Any increase in the Subscription Fee will be notified on the Website (by a news story in Our Night Times news section) no less than one month prior to the increased Subscription Fee commencing.

Cancelation

If You wish to cancel Your Account and/or Subscription at any time then You must go to the ‘Edit Account’ section in ‘Your Account’. Any Monthly Payments payable after the Termination Date should be terminated immediately however We recommend that You cancel the direct debit relating to Your Subscription Fee with Your nominated bank.

Termination

If You submit inappropriate images or text as outlined above then Your Account and/or Subscription will be terminated. In order for Us to terminate Your Account and/or Subscription You must be in breach of the Terms and Conditions stated. Please refer to the Payments section for information on Your Subscription Fee where Your Account and/or Subscription has been terminated.

Refunds

Please note that if the Website is inaccessible or shutdown due to a fault by Us for a period longer than 72 hours You will be afforded a refund of the Subscription Fee for the month during which the Website was not available. To claim this refund You must email roar@nightzookeeper.com. If You are having connection issues with Your internet service provider or computer access then You are not eligible for the refund.

If You wish to quote, link, reference or recommend Us or the Website You must not claim to have an association or affiliation with Us or the Website unless authorised by Us to do so. To request authorization please contact Us at roar@nightzookeeper.com.
